HAMILTON SAFE PRODUCT WARRANTY:

The Seller hereby warrants the product for its normal use and service for a period of twelve (12) months   from the date of shipment of such product.  The Seller's obligation under this warranty is limited to repairing, or at its option, replacing the part of the complete unit without cost to the Purchaser within a  reasonable time after the receipt of written notice as to such defect and which its examination shall  disclose to its satisfaction to have been defective.  This warranty extends only to the original Purchaser of new equipment and shall be void if the product is repaired or tampered with in any   manner by other than the Dealer's authorized service personnel.  It is agreed by and between the parties that the Seller is not an insurer; that the payment herein before named is based solely on the    value of the equipment and services provided herein; that, from the nature of the equipment and services to be rendered, it is impractical and extremely difficult to fix the actual damages, if any, which may proximately result from a failure on the part of either the Seller or its equipment to perform any of its intended functions.  Seller's liability hereunder shall be limited to and fixed at not more than $500 per product unit, or 10% of the product price, whichever is greater, and the Seller shall not be liable for any loss or damage sustained through burglary, theft, robbery, fire or  any other special, indirect or consequential damages.  Such liability as above set forth is fixed as liquidated damages and not as a penalty and this liability shall be complete and exclusive.

All Product returns are subject to a 25% Restocking Fee.

FireKing File Warranty

If a mechanical or operable part of the FireKing records container malfunctions or breaks down during normal use, FireKing, will at its option, repair or replace such part FREE for three (3) years from the date of purchase. Associated labor costs for the repair or replacement of these parts will be paid by FireKing (with authorization in advance). In addition, in the event that a FireKing file is damaged in a fire, at any time while in the possession of the original purchaser, FireKing will replace the cabinet free of charge, and ship it freight collect to the original owner.

FireKing MediaVault Warranty

If a mechanical or operable part of the FireKing Media Vault malfunctions or breaks down during normal use, FireKing, will at its option, repair or replace such part FREE for three (3) years from the date of purchase.

FireKing Safes

If a mechanical or operable part of a FireKing safe malfunctions or breaks down during normal use, Fire King International will at our option, repair or replace said part free for a period of one (1) year from the date of purchase.

FireKing safes (other than data safes) are protected by a lifetime guarantee for free replacement in the event of damage by fire. In the event that a FireKing safe is damaged in a fire, at any time while in the possession of the original purchaser, Fire King International will replace the safe free of charge and ship it freight collect to the owner.

Schwab Corp Warranty

Lifetime Fire Replacement
In the event this file is damaged by fire while in the possession of the original purchaser as shown on the warranty registration card, Schwab Corp. warrants that it will replace the file free of charge, however all freight costs are to be borne by the purchaser.

Lifetime File Parts
K.L. Security Enterprises, Inc. warrants that it will repair or replace, at K.L. Security Enterprises, Inc.’s option, any file part manufactured by Schwab, that fails in normal use as a result of defects in materials or workmanship, free of charge except for shipping and handling charges for as long as the original registered purchaser owns the file.

Labor
Schwab will furnish the labor associated with any defective part replacement for a period of two years from the date of purchase. All such labor charges must be authorized in advance by K.L. Security Enterprises, Inc. and Schwab in writing. All labor will be performed at service centers or by service providers designated by Schwab.

Parts Manufactured by Others
K.L. Security Enterprises, Inc. and Schwab does not warrant any product, components or parts, such as locks, not manufactured by Schwab, however, to the extent that the manufacturer provides a warranty and the warranty is assignable, Schwab hereby assigns that warranty to the purchaser.

Disclaimer of Warranty
THIS WARRANTY IS LIMITED TO THE TERMS STATED HEREIN. IT IS IN LIEU OF AND SUPERSEDES ANY OTHER WARRANTY WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Remedies
In no case shall K.L. Security Enterprises, Inc. or Schwab be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict tort, or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of savings or revenue, loss of use of the file or any associated equipment, loss of the contents of the file, cost of capital, cost of any substitute equipment, facilities or services, downtime, the claims of third parties including customers, and injury to property. Some states do not allow limits on warranties, or on remedies for breach in certain transactions. In such states, the limits in this paragraph and in the prior paragraph may not apply.

Warranty Registration Card
It is a requirement of this warranty that the registration card showing the serial number of the file and original purchaser information must be on file with Schwab within sixty (60) days of purchase to validate this warranty. Failure to register the product and original purchaser shall void any warranty.

No Other Warranties
Unless modified in writing signed by both parties, this agreement is understood to be the complete and exclusive agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this agreement. No employee of K.L. Security Enterprises, Inc. or any other party is authorized to make any warranty in addition to those made in this agreement.

Allocation of Risks
This warranty allocates the risks of product failure between K.L. Security Enterprises, Inc. and the purchaser. This allocation is recognized by both parties and is reflected in the price of the goods. The purchaser acknowledges that it has read this agreement, understands it, and is bound by its terms.
